Digital Learning Regulatory Outlook: The Impact of the Pandemic and Elections

What regulatory changes are in the air for online, blended, remote, or any other form of digital learning that you are currently offering? 

The session begins with a review of the prospects of what the recent election may mean for changes for higher education, financial aid, funding, and regulations. 

Next, we will highlight how the regulations change when a course is transformed from a face-to-face to digital format. These changes are highlighted in the publication: Pursuing Regulatory Compliance for Digital Instruction in Response to Covid-19: Policy Playbook. Faculty might not realize that making this transition is as if they have crossed an invisible state line and the laws have changed. Van DavisVan Davis, Policy and Planning Consultant, WCET and Principal, Foghlam Consulting 
Dr. Van Davis is a Policy and Planning Consultant for WCET. Van is also Principal at Foghlam Consulting, LLC where he focuses on higher education policy, distance education, college affordability, competency-based education, educational technology, and strategic planning. He has over 20 years of experience in higher education as a professor, academic administrator, state policymaker, and educational technology executive. Van currently serves on the board of PelotonU, a 501c3 that provides academic and social support services for post-traditional students enrolled in online competency-based education degree programs, and is a Senior Fellow with the Council for Adult and Experiential Learning (CAEL). He holds a PhD in 20th Century US History with an emphasis on civil rights history from Vanderbilt University, and lives in Austin, Texas with his beloved wife and two cats.

Cheryl DownCheryl Dowd, Director, WCET State Authorization Network 
Cheryl Dowd is the Director for the State Authorization Network (SAN). Dowd direct a membership organization of more than 800 post-secondary institutions and state agencies nationwide providing activities and research to support, understand, and develop strategies to maintain State and Federal regulatory compliance requirements for out of state activities of the member institutions.  Dowd is a contributing author for a guide book for understanding the legal basis for State and Federal compliance for activities of post-secondary institutions, State Authorization of Colleges and Universities. Dowd earned her Juris Doctorate from the University of Richmond, master’s degree in Criminal Justice from Bowling Green State University, and bachelor’s degree in Political Science from James Madison University.


Russ PoulinRuss Poulin, Executive Director, WCET 
Russ Poulin leads WCET, the WICHE Cooperative for Educational Technologies, which focuses on the practice, policy, and advocacy of technology-enhanced learning in higher education. WCET’s members hail from all fifty states and a few from Canada. As WICHE vice president, he advises on policy and projects for the regional higher education compact. Poulin represented the distance education community on federal negotiated rulemaking committees and subcommittees. He has received recognition from the Presidents’ Forum, Excelsior College, and the National University Technology Network for his contributions to policies for technology-enhanced postsecondary education. Poulin received a bachelors from the University of Colorado Denver and a masters from the University of Northern Colorado. He is also partial to movies, cats, and his wife, Laurie.
