Federal Update
- July 1, 2024 effective date is here for - Responsibility, Administrative Capability, Certification Procedures, Ability to Benefit (ATB), includes Professional Licensure new regulations(34 CFR 668.14(b)(32)).
- Certification Procedures 668.14(b)(26) "maximum/minimum rule" for gainful employment programs - 360 Degree Education, LLC et al v. U.S. Department of Education et al, preliminary injunction granted, the rule is ENJOINED pending resolution of the lawsuit (means that this particular subsection is on hold from enforcement). ED Electronic Announcement
- U.S. Department of Education representative, Antoinette Flores, shared via email that the eCFR is incorrect including the 3 public disclosure lists (A)-(C). ED is having eCFR updated. 34 CFR 668.43(a)(5)(v)
- June 28, 2024 - LOPER BRIGHT ENTERPRISES ET AL. v. RAIMONDO, SECRETARY OF COMMERCE, ET AL. U.S. Supreme Court struck down the Chevron Deference, a 40 year old precedent that provided executive agencies with broader latitude to interpret federal statutes and develop regulations where a federal statute was ambiguous or does not address a specific issue.
